Azuara & Baviera is a law firm that opened its doors in the matrimonial area in November 2009. Dealing with an area of law in which economic matters are mixed with sentimental ones, it’s of great importance to have the advice of someone who can look after our interests in a close and personal way.
We spoke to Eduardo Baviera, head of the firm.
Why do you specialise in matrimonial matters, divorces and separations?
The reason for my choice in this area of law is because it is a very attractive area from the point of view of service to people, considering that people are in situations where they need good legal and personal support. In the field of matrimonial law, the social service of the legal profession is enhanced. We learn from the experiences of our clients and are personally enriched by them.
Explain to us your working philosophy: the trial as the last resort in a divorce case.
Our work philosophy is, above all, to treat each client as a unique and unrepeatable case, and for this reason we dedicate all the time, knowledge and effort necessary to seek the best possible solution, taking into account the particularity of each case. Our objective is to look after not only the interests of the parents but especially for the rights and interests of the children.
Our efforts are aimed at firmly defending the interests of our clients through negotiation and, therefore, we advise that litigation should be the last resort to solve problems. We believe that being skilled negotiators allows us to reach satisfactory agreements for all parties, avoiding court proceedings that are ultimately costly and emotionally draining.
How has the crisis affected your area of specialisation?
As far as our practice is concerned, although it is true that divorce and separation proceedings have decreased as a consequence of the crisis, we have noticed an increase in claims relating to the modification of measures adopted in previous agreements, especially reductions in alimony requested by the paying spouse.
Do you work in other areas of law?
Our firm specialises in the area of matrimonial and family law. However, as an intrinsic and necessary part of our work, family financial planning makes us experts in wealth management. We set up companies according to their purpose: property management, artistic assets, holding companies… Our experience covers several countries around the world.
Is money the only important thing in this field of law?
After a marital break-up, there is a profound change in people’s lives, which often leads to mixed feelings about the partner: guilt, anger, frustration. However, once the initial phase is over, and leaving aside the emotional or psychological aspect, most of the problems between the couple focus on the economic aspect.
At this point, personal relationships become of secondary importance, so that financial concerns will determine a turning point in the couple’s relationship.
We must not forget that separation and divorce oblige the ex-spouses to adopt a series of economic measures to provide for the custody and maintenance of the children and to compensate the more disadvantaged spouse as a result of the break-up, and for all these reasons, money will be one of the most conflictive points in the couple’s relationship.
